THE TERMS OF USE of TXT402.COM

The hereby given regulations are meant to introduce and harmonize the terms of use of the TXT402.com site in reliance on the mandatory rules and for the sake of ensuring an adequate quality of services.

I. GENERAL PROVISIONS

1. TXT402 is a system involving charging customers with a fee for displaying the users Passwords in an electronic way.

2. TXT402.com is a system offering a fast and save sharing, exchange and distributing content system, along with an appropriate payment mechanism to manage these operations.

3. The system gives the opportunity to proceed payments for goods and services offered on it's site, using it's own, unique mechanism along with payment features available on the market. TXT402 is a middleman in transactions between it's users and customers, implementing buy-sell of Password and collects a commission from it.

4. Upon the above mentioned Terms 'services' stand for electronic and interactive services, involving storing, sharing and distribution of a content being owned by the system user,assuming the use of a quick and easy micropayment system.

5. TXT402 provides an appropriate IT infrastructure assuring the system's operation, enabling secured share, display and exchange of Password and profiting from it.

6. Password is a string of up to 250 alphanumeric characters, such as uppercase and lowercase letters, numbers and special characters. It's the main exchange and sharing content unit within the system.

7. Every Password submitted in the system receives an individual ID number, stored within the TXT402 system throughout the existing period of a particular user's account. The user has a right to add and delete Password of his choice.

II. USAGE PRINCIPLES

1. Using the site every user accepts to be bounded by the Terms of Use and regulations and undertakes not to act to the system loss or any other entity.

2. Registering in the system TXT402 the user agrees to receive information about the functioning of the system send at the e-mail address given in the registration form.

3. The user commits furthermore to abide by the law, of which the above mentioned Terms of Use obey and to respect the rights of other users and the Internet rules in general.

4. The system is available for every person who is over 18 years old and went through the registration process.

5. The account may be established by every individual or business entity and other legally existing.

6. Registering in the system every user establishes an individual account, where he collects any of his Passwords, sells them and manages other operations that go along with it.

7. According to the ACCEPTABLE USE section any kind of breach of the operating regulations or the system usage will be strictly under control of the system administrator, including taking out consequences from such behavior.

III. USER'S ACCOUNT, RULES AND PAYMENTS

1. After the registration process every TXT402 user receives his own user account, where he collects sold and on sale Passwords, earned money and all bonuses resulting from establishing it. Joining the TXT402 system every user assures authenticity and completeness of his personal data provided in the registration form.

2. TXT402 commits to provide confidentiality of all the data submitted by the users that requires to be legally protected (see PRIVACY POLICY).

3. The account is available to those of users, who successfully finished the registration process and want to earn and receive other benefits from the sole fact of sharing their Password. The account enables users to share Password at a price estimated by themselves, monitor their Password sharing statistics, manage their account and buy with discounts Password form other TXT402 users.

4. Establishing and usage of the account is free of charge.

5. The currency in which all transactions are being settled at TXT402 is EUR.

6. Every transaction made within the system needs to be provided by PayPal system.

7. The user estimates the price he wants to share and sell his Password for. The minimum price to set is 0,5 EUR and the maximum is 50.00 EUR. The user can also share his password for free.

8. The user can modify the price he estimated at any time of setting his Password to share. The amount earned by the user extends depending on the number of views.

9. From every user Password's sale, the system collects a commission worth 10% + 0,35 EUR.

10. The minimum amount to payout from the user's account is 10 EUR.

11. Users have a possibility to accumulate their earnings on the account, pay out every 10,00 EUR they earn or it's multiple, or to market their earnings within the system, buying or investing it in the content of their interest.

12. To pay out the account's earnings it is necessary to establish a PayPal system account. After the user decides to click the PAY button in his user's account panel, TXT402 transfers his earnings amount from the account to PayPal account.

13. The user can choose and add to pay out the 10.00 € or it's multiple at any time. TXT402 provides the payouts every Monday.

14. The account unused after registration expires within 180 days.

15. Account not activated 7 days after registration expires and is deleted from the TXT402 system resources. The user receives an Information about the fact on his e-mail given in the registration form.

16. The user has an option to resign from the TXT402 services. The resignation is being handled through a proper bookmark in the user's account panel. After choosing the option DELETE ACCOUNT there will be a generated link sent to the user's e-mail address he provided in the registration form, needing to be confirmed, so that the resignation process can be finished successfully.

17. The moment the user has decided to close the account in the TXT402 system, all of his earnings less than the amount of 10 EUR cannot be payed out from the system in the resigning user's favor. The user can either payout all of his earnings before he quits his account or collect the above mentioned 10 EUR to cash it ultimately via PayPal and then quit the services.

18. TXT402 users are fully responsible for confidentiality of their access data, such as login and password. They also take sole responsibility for every modification within their account.

19. An additional way to gain money through the system is joining the Partnership Program, where it is possible to receive an each time 2% bonus along with payouts, for passing the registration link to the user's friends or clients who will join the system from the user's recommendation. The number of registered partnerships is measured by the activation link downloaded from the appropriate system site and sent to these people who'll sign up from it.

IV. ACCEPTABLE USE

1. TXT402 enables to distribute whichever content being owned by the system users regardless of it's size or subject, except for illegal Password, such as containing children pornography, causing any kind of injustice to minors, abusing the copyrights of a third party, containing racist themes or gloryfying violence and inciting or providing guidance to commit crimes. This above mentioned catalogue is not a closed one.

2. Once TXT402 has given notice of sharing the above mentioned, illegal Password content by the system users, it has the right to an immediate blockade of such user's account access and it's resources (including his earnings). Also, TXT402 will provide the right authorities with access to such account and the abusing user's data.

3. The system users undertake to exert the system in compliance with the Copyrights Act and not to breach any of it's regulations.

4. In case the user undertook an operation not forbidden by the Terms of Use but recognized by TXT402 as undesirable, it will notify the user via e-mail about this fact, with a demand of cessation to continue such operations. If the user doesn't apply to this demand immediately, it will be treated as an infringement of the Terms of Use and may effect in a blockade or the account's removal from the system supplies.

5. The examples of infringement contain: an unauthorized access or usage of TXT402.com, every attempt of inquiry or testing on the system's suspectibility of attack, safety infringement, or the centre's of identification overflowing, purposeful attempts of the system overload and broadcast attacks, using devices, program's or methods having the aim of interfere the correct functioning of the system and every case of excessive or disproportional burden of the TXT402 system's infrastructure.

6. Every attempt of breach of the Terms of Use regulations and it's propagation will be also recognized as infringement.

V. LIMITATION OF LIABILITY

1. TXT402.com does not bear responsibility and does not have any influence on the kind and subject of particular Password submitted by the users to share within the system.

2. TXT402 does not bear responsibility for assuring suitable quality of the offered services, as well as the quality of shared Password.

3. TXT402 does not bear responsibility for copyright or other users rights by a third party.

4. TXT402 does not bear responsibility for the way the users operate within the system, as well as the effects it may cause.

5. Furthermore TXT402 does not take responsibility for any kind of damage resulting from misconduct or false use of sharing Password, or inability of sharing it. TXT402 does not bear responsibility for entering into the user's password possession by unauthorised third party, regardless of the cause of such incident.

6. The user clearly understands and expresses his consent that TXT402 does not bear responsibility for any special damages, direct or secondary, including results from the loss of: profits, the company's value, the number of users, data, or different immaterial losses resulting from use or loss of possibility of the service's usage, bearing the cost of purchase of goods and supplementary services or any different causes connected with the service's offer.

VI. FINAL PROVISIONS

The Terms of Use enter into force on 11-10-2009 . TXT402 reserves the right to an unilateral change of the Terms of Use regulations, notice of which would be given to users appropriately. TXT402 reserves the right to develop, improve, change, upgrade and resupply the system.
